STATE OF TEXAS ( ) COUNTY OF GALVESTON ( ) EASEMENT DEED THAT WE, Cane Corporation, of the County of Galveston, State of Texas (called Grantor) in consideration of the sum of one (1.00) dollars and other good and valuable consideration in hand paid by the City of Friendswood, Galveston County, Texas, the receipt of which is hereby acknowledge do by these presents GRANT, BARGAIN, and CONVEY subject to the reservation hereinafter made; unto said iE 44,4 {gip City of Friendswood, of Galveston County, Texas, a public utility easement for adY O the free, perpetual and uninterrupted use, liberty and privilege of the passage in, m along, upon and across the following described land situated in Galveston County, Texas, owned by us: TRACT NO. 6: Being a 7.50 foot easement over and across that certain tract or parcel of land known as Tract 6, a part of CANE CORPORATION 67.215 acre tract in the Perry and Austin League, Abstract 20, Galveston County, Texas and Abstract 11, Brazoria County, Texas, said 7.50 easement being more particularly described by metes and bounds as follows to wit: Beginning at a point for corner in the southwesterly line of said 67.215 acre tract, also being the northeasterly line of WEST FRIENDSWOOD SUBDIVI- SION, said part being N44°56'35"W, 1326.00 feet from the east corner of WEST FRIENDSWOOD SUBDIVISION, said east corner of FRIENDSWOOD SUBDIVISION also being the point of intersection of the southwesterly line of said 67.215 acre tract and the southwesterly line of the Perry and Austin League, which is also the ceater line of State Highway FM No. 2351. Thence N45°E a distance of 245.75 feet to a point in the southwest right of way line of Chester Drive; Thence N45°W and along the southwesterly right of way line of Chester Drive a distance of 7.50 feet to a point for corner; Thence S45°W a distance of 245.75 feet more or less to a point in the southwesterly line of above said 67.215 acre tract of land and the northeasterly line of said WEST FRIENDSWOOD SUBDIVISION; Thence S44°56'35"E and along the southwesterly line of said 67.215 acre tract of land a distance of 7.50 feet to the place of beginning. Containing 1843 square feet of land more or less The Grantor herein excepts from this easement and reserves for themselves, their heirs and assigns, forever, all oil, gas and other minerals in and under the land covered by this easement, but said Grantors for themselves, their heirs and assigns, waive all right of ingress and egress to and from the surface of the land covered by this easement for the purposes of drilling, mining, exploring for or developing such minerals. For the purpose of opening, laying, repairing, constructing and maintain- ing a permanent easement upon and across said premises, with the right and privi- lege at all times of the Grantee herein, his or its agents, employees, workmen, successors and assigns and representatives having ingress, egress and regress in, along, upon and across said easement for the purpose of making additions to, improvements on, laying, repairs, and replacements to said sewer, gas and/or water conduits, latterals, lines and connections thereto, or any part thereof. TO HAVE AND TO HOLD unto the said City of Friendswood, of Galveston County, Texas, as aforesaid for the purposes aforesaid, the premises above described.
