HomeMy WebLinkAboutEasement Deed - Cecil & Mary Brown - 705 W EDGEWOOD DR • • 95422 EASEMENT DEED THE STATE OF TEXAS KNOW ALL MEN BY THESE PRESENTS: COUNTY OF GALVESTON ) THAT WE, CECIL BROWN, JR. , AND WIFE MARY BROWN, for and in consideration of the sum of One and no/100 ($1. 00) Dollar, cash to us 9O QC in hand paid by the City of Friendswood, Texas, receipt of which is hereby ir.. acknowledged, and the further consideration of the benefits to be derived by us on account of the construction and maintenance by the City of Friends- M �� '- wood, Texas of said lift station, do hereby give and grant to the said City of Friendswood, Texas, a municipal corporation of Galveston County, Texas, the right to construct, reconstruct and perpetually maintain a sanitary sewer lift station upon the hereinafter described easement out of the following described property, to-wit: A tract of land out of Lot 1 Block "A" Central Park Subdivision in the Sarah McKissick or J. R. Williams League, Abstract No. 151, Galveston County, Texas. COMMENCING at the North corner of said Lot 1 Block "A", said corner also being the point of intersection of the centerlines of State Highway F. M. 2351 and Sunset Drive; THENCE South 45 degrees East, along the Northeast line of Lot 1, Block "A", same being the centerline of Sunset Drive , a distance of 50 feet to point for corner; THENCE South 45 degrees West, parallel with the Northwest line of Lot 1, Block "A", and the centerline of F. M. 2351, at a distance of 40 feet pass the point of intersection of the Southwest line of Sunset Drive and the Southeast line of F. M. 2351, and continue on South 45 degrees West, parallel with the Northwest line of Lot 1, and along the Southeast r. o. w. line of F. M. 2351, in all a total distance of 330 feet to a point for BEGINNING of the tract herein described; THENCE continuing South 45 degrees West, parallel with the Northwest line of Lot 1 and along the Souheast r. o. w. line of F. M. 2351 a distance of 10 feet to point for corner; THENCE South 45 degrees East, parallel with the Northeast line of Lot 1, a distance of 10 feet to point for corner; THENCE North 45 degrees East, parallel with the Northwest line of Lot 1 a distance of 10 feet to point for corner; THENCE North 45 degrees West, parallel with the Northeast line of Lot 1 a distance of 10 feet to the PLACE OF BEGINNING of the tract herein described. TO HAVE AND TO HOLD the same perpetually to the City of Friendswood, Texas and its successors, together with the rights and privileges at any and all times to enter said premises, or any part thereof, for the purpose of constructing, reconstructing, and maintaining said Lift station, and for making connections therewith; upon the conditions that the City of Friendswood, Texas will, at all times, after doing any work in connection C with the construction, reconstruction, repair or removal of said lift station, or any lateral thereof, restore said premises to the condition in which same ac was found before such work was undertaken and that in the use of said rights and privileges herein granted, the City of Friendswood, Texas will not create a nuisance or do any act that will be detrimental to said premises. THE HEREIN DESCRIBED EASEMENT shall be burdened with the requirement that said lift station, when completed, shall be camouflaged with plantings and at all times kept trimmed and clean. FURTHER, during the installation of said lift station, the City of Friendswood shall have the right to use a strip of land adjacent to the above described permanent easement, Twenty (20) feet in width along the Northeast side of said permanent easement. The Grantee, the City of Friendswood, shall confine its operations hereunder, including its rights of ingress and egress, to the said described Twenty (20) foot strip and easement. If construction is not started within six months from the date of this easement this instrument shall become null and void. Further, if said easement is discontinued by the Grantee said ease- ment shall revert back to Grantors, their heirs or assigns. WITNESS OUR HANDS, this the /- day of �,`,�9 A. D. 1973.
