COUNTY OF GALVESTON ) KNOW ALL ME SE PRESENTS:
THAT WE, Cecil Brown, Jr. and wife, Mary Brown, of the County of Galves-
ton, State of Texas (called Grantor) in consideration of the sum of Ten ($10. 00)
Dollars and other good and valuable consideration in hand paid and hereinafter
agreed to by the WATER CONTROL & IMPROVEMENT DISTRICT #15, OF GALVES-
TON COUNTY, TEXAS, the receipt of which is hereby acknowledged do by these
presents GRANT, BARGAIN, SELL and CONVEY subject to the reservation herein-
after made; unto said Water Control & Improvement District #15, of Galveston
County, Texas, the free, perpetual and uninterrupted use, Liberty and privilege of
the passage in, along, upon and across the following described land situated in
Galveston County, Texas, to-wit:
A Right-of-Way Easement out of Lot 2 Block 3 of the Friendswood Sub-
division in the Sarah McKissick League Galveston County, Texas
described by metes and bounds as follows:
Beginning at the North corner of Lot 2 Block 3, which point is in the
center Line of a plotted 40 foot County Road, now assumed to be widened
to 60 foot road; thence Southeast along the Northeast line of Lot 2 a
distance of 767. 5 feet to the beginning point of the easement herein
described; thence, Southwest, parallel with the Southeast line of Lot 2
a distance of 427. 5 feet to point for corner; thence, Northwest parallel
with the Northeast Line of Lot 2 a distance of 737. 5 feet to the Southeast
boundry Line of a County Road for corner; thence, Southwest along the
Southeast boundry line of said County Road a distance of 15 feet to point
for corner; thence, Southeast parallel with the Northeast Line of Lot 2
a distance of 752. 5 feet to point for corner; thence, Northeast, parallel
with the Southeast line of Lot 2, a distance of 427. 5 feet to point for
corner; thence,. Southeast, parallel with the Northeast line of Lot 2,
a distance of 103 feet to point for corner; thence, Northeast, parallel
with the Southeast line of Lot 2, a distance of 15 feet to the Northeast
Line of Lot 2 for point for corner; thence, Northwest along the Northeast
line of Lot 2 a distance of 118 feet to the place of beginning.
At the present time, there are two water lines, a gas line and a private
shell road crossing the above easement that serves the Grantor's home.
Part of the consideration of this conveyance is the agreement between
Grantor and Grantee that these water and gas Lines and road may remain
across the easement, and that Grantee agrees that care shall be taken
of said lines so as not to disrupt Grantor's use of said Lines and that
the road will be restored to its present condition as quickly as possible.
The Grantor herein excepts from this easement and reserves for themselves,
their heirs and assigns, forever, a.11 csiL, gas and other minerals in and under the
Land covered by this easement, :1313,C,,saTH Grantors for themselves, their heirs
and assigns, waive all right of ingress and egress to and from the surface of
the land covered by this easement for the purposes of drilling, mining, exploring
for or developing such minerals.
For the purpose of opening, laying, repairing, constructing and maintaining
a permanent easement upon and across said premises, with the right and privilege
at all times of the Grantee herein, his or its agents, employees, workmen,
successors and assigns and representatives having ingress, egress and regress
in, along, upon and across said easement for the purpose of making additions to,
improvements on, laying, repairs and replacements to said sewer and/or water
conduits, latterals, lines and connections thereto, or any part thereof.

TO HAVE AND TO HOLD unto the said Water Control & Improvement Dis-
trict #15, of Galveston County, Texas, as aforesaid for the purposes aforesaid,
the premises above described.

BEFORE ME, the undersigned authority, on this day personally appeared
CECIL BROWN, JR. and MARY BROWN, his wife, both known to me to be the
persons whose names are subscribed to the foregoing instrument, and acknowledged
to me that they executed the same for the purposes and consideration therein
expressed and the said MARY BROWN, wife of the said CECIL BROWN, JR.
having been examined by me privily and apart from her husband, and having the
same fully explained to her, she, the said MARY BROWN acknowledged such
instrument to be her act and deed and she declared that she had willingly signed
the same for the purposes and consideration therein expressed, and that she did
not wish to retract it.

RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF FRIENDSWOOD, TEXAS
AUTHORIZING MAYOR TO EXECUTE A
DEED CONVEYING BACK TO CECIL
BROWN, JR. AND WIFE, MARY BROWN,
THE DEED ATTACHED HERETO.
WHEREAS CECIL BROWN, JR. and wife MARY BROWN, of the County
of Galveston, State of Texas, did by Deed grant a right-of-way easement to
Water Control and Improvement District No. 15, of Galveston County, Texas
on the 18th day of December A. D. , 1963, said Deed being found of record in
Deed Record Book, Volume 1607, Pages 96 and 97, of the records of the Coun-
ty Clerk of Galveston County, Texas; and
WHEREAS the City of Friendswood, Texas did assume all the rights
and privileges, debts and liabilities of said Water Control and Improvement
District No. 15 by City Ordinance enacted on the ,jolLday of /1 ,, 19 1 ;
and
WHEREAS it is the desire of the City of Friendswood to obtain addition-
al right-of-way from the said CECIL BROWN, JR. and wife, MARY BROWN,
now therefore,
BE IT RESOLVED by the City Council of the City of Friendswood, Texas
that the Mayor, RALPH L. LOWE, be authorized to execute the deed conveying
back to CECIL BROWN, JR. and wife, MARY BROWN, the right-of-way descr-
ibed in the deed, a copy of which is attached to this resolution and which is set
forth as follows:

THAT WHEREAS CECIL BROWN, JR. and wife MARY BROWN, of the
County of Galveston, State of Texas, did by Deed grant a right-of-way easement

grant, bargain, sell and convey unto CECIL BROWN, JR. and wife, MARY BROWN,
all right, title and interest whatsoever received by the said Water Control and
Improvement District No. 15 in the deed hereinabove described by volume and
page number said land situated in Galveston County, Texas, to-wit:
