HomeMy WebLinkAboutDeed Granting Utility Easement - Austin Consolidated, Inc. - 40538 • ' 4,C538 �•, c j DEED GRANTING UTILITY EASEMENT BOOK2563 fA; 12 THE STATE OF TEXAS 1 COUNTY OF GALVESTON 1 WHEREAS, AUSTIN CONSOLIDATED, INC. , a Texas corporation , is the developer of Greenbriar Subdivision, Section 1 , a subdivision recorded in Volume 15 , Page 8, in the Office of the County Clerk of Galveston County, Texas ; and WHEREAS , one certain ten (10) foot utility easement was erroneously omitted from the plat of said subdivision ; and WHEREAS , AUSTIN CONSOLIDATED, INC. , is the owner and holder of Lots 1 , 2 , 3, 4, 5, 6 and 7, Block 1 , and Lots 1 , 2 , 4 and 5 , Block 2 , of said subdivision , and THOMAS S. CHRIST and wife , SHERRY L. CHRIST, are the owners and holders of Lot 3, Block 2 , of said subdivision; NOW THEREFORE, KNOW ALL MEN BY THESE PRESENTS that AUSTIN CONSOLIDATED, INC. , and THOMAS S. CHRIST and wife, SHERRY L. CHRIST, hereinafter referred to as Grantors , in consideration of ONE ($1 .00) DOLLAR and other good and valuable consideration, the receipt of which is hereby acknowledged, have GRANTED, BARGAINED, SOLD AND CONVEYED, and by these presents do GRANT, BARGAIN, SELL AND CONVEY to the City of Friendswood, Galveston County, Texas , and to all public utility companies who may provide utility service to said subdivision, their successors and assigns , a right-of-way and easement for the purpose of laying, maintaining, and operating utility lines thereto across the property described as follows : (1 ) The Southeasterly 10 feet of Lots 1 , 2, 3, 4 and 5, Block 2 , of Greenbriar Subdivision , Section 1 , as recorded in Volume 15, Page 8, in the Office of the County Clerk of Galveston County, Texas ; and (2) The Southwesterly 10 feet of Lots 1 , 2, 3, 4, 5, 6 and 7, Block 1 , of Greenbriar Subdivision, Section 1 , as recorded in Volume 15, Page 8, in the Office of the County Clerk of Galveston County, Texas ; together with the free right of ingress and egress over and across such property, insofar as such right of ingress and egress is necessary to the proper use of any other right granted herein . TO HAVE AND TO HOLD perpetually the said right-of-way and easement unto the said Grantees , their successors and assigns , all upon the conditions that the Grantees will at all times , after doing any work in connection with 'the construction, reconstruction or repair of said utility lines , restore . : i Al said premises to the condition in which the same were found before such work C was undertaken , and that in the use of said rights and privileges herein granted, the Grantees will not create a nuisance or do any act that will be 1 detrimental to said premises. aU WITNESS our hands this day of April , 1975.
