Hansen, Jr. and wife,Ellen M. Hansen , of County, Texas, in consideration of the sum of Ten ($10. 00) Dollars and other good and valuable consideration in hand paid by the City of Friendswood, acting through its duly elected councilman, receipt of which is hereby acknowledged, do by these presents grant, bargain, sell and convey, subject to the reservation hereinafter made, unto the City of Friendswood, the free and uninterrupted use, liberty, and privilege of the passage in, along, upon and across the following lands in Galveston County, Texas, owned by us; to-wit: A tract of land 60 feet by 3l7 feet out of Lot 5, Block Ll, of the Friendswood Subdivision, of the Sarah McKissick or J. R. Williams League, Galveston County, Texas, described by metes and bounds as follows; to-wit: Beginning at the West corner of Lot 5, Block ll, which point is also the South corner of Lot 2; Thence Northeast along the dividing Line between Lots 2 & 5 a distance of 630 feet, to the beginning point of the tract herein described; Thence continuing Northeast along the Northwest Line of Lot 5, a distance of 60 feet, to point for corner; Thence Southeast parallel with the Southwest line of Lot 5, a distance of 3L7 feet to point for corner; Thence Southwest parallel with the Southeast Line of Lot 5, a distance of 60 feet, to point for corner; Thence Northwest parallel with the Southwest Line of Lot 5, a distance of 3l7 feet to the Northwest boundry Line of Lot 5, and the place of beginning. The Grantors herein except from this easement and reserve for themselves, their heirs and assigns, forever, all oil, gas, and other minerals, in and under the Land covered by this easement, but said Grantors, for themselves, their heirs and assigns, waive all right of ingress and egress to and from the surface of the land covered by this easement for the purposes of drilling, mining, exploring or developing such minerals. For the purposes of opening, constructing and maintaining a permanent road or State Highway in, along upon and across said prem- • egress, and regress in, along, upon and across said premises for the pruposes of making additions to improvements on, and repairs to the said road or highway, or any part thereof. Hansen , both known to me to be the persons whose names are subscribed to the foregoing instrument and acknowledged to me that they both executed the same for the purposes and consideration therein expressed, and the said Ellen M. Hansen wife of the said Hans E. Hansen, Jr. , having been examined by me privily and apart from her husband, and having the same fully explained to her, she, the said Ellen M. Hansen , acknowledged such instrument to be her act and deed, and she declared that she had willingly signed the same for the purpose and consideration therein expressed, and that she did not wish to retract it.
