TO HAVE AND TO HOLD the above described easement, together with all and singular the rights and appurtenances thereto in any wise belonging unto the said Grantee, its successors and assigns forever, and Grantors bind themselves and their heirs, executors, and administrators to warrant and forever defend all and singular the Property unto the Grantee and Grantee's successors and assigns against every person whomsoever lawfully claiming or to claim the same or any part thereof, except as to the reservations from and exceptions to conveyance and warranty hereinabove provided,when the claim is by,through, or under Grantors,but not otherwise. Friendswood Drive Friendswnnri T 77gAa Aoce • 013-61 - 1315 Grantee may do and perform on said easement and right-of-way, and on an area ten feet (10') wide on each side of the easement and right-of-way, all acts necessary to construct, reconstruct, repair, relocate, remove, or maintain utility improvements and drainage and public utility improvements incident thereto and operate thereon all necessary machinery and equipment to efficiently prosecute the work. Provided however, that the area ten feet (10') wide on each side of the easement and right-of-way is a temporary easement only for the duration of the construction of any improvements authorized hereunder. The Property is conveyed subject to any and all matters of record, as filed in the official property records of Galveston County, Texas, and is further subject to any condition existing on the grounds, if any, which may affect the above described property in any manner.
