Heritage Drive; authorizing the Mayor to execute and the City Secretary to attest a Quitclaim Deed by and between the City and First Baptist Church of Friendswood. Originating Department: Community Development Degree of importance: Significant SUMMARY/ ORIGINATING CAUSE First Baptist Church Friendswood owns all four of the tracts abutting the subject property and is requesting that this portion of right-of-way be vacated. Currently, the right-of-way is unimproved (see attached photo), and is a dead end with no potential for extension due to the proximity to the creek. All of the no objection letters from the utility companies clearly portray that there is no intent to improve or extend utilities to this area. The church is in the process of making long-term plans to improve their campus. Currently, this portion of property would remain as green space. IMMINENT CONSEQUENCES / BENEFIT TO COMMUNITY Allowing the church to take ownership of the property would allow them to maintain the property. No objection letters were provided by the following entities - City of Friendswood, Galveston County Consolidated Drainage District, Centerpoint, Texas New Mexico Power, AT&T and Comcast. RECOMMENDATIONS At the Planning and Zoning Commission meeting held March 26, 2020, following the Public Hearing, the City of Friendswood Planning and Zoning Commission voted unanimously 7-0 to approve the request to vacate a portion of 60-foot right-of-way on East Heritage Drive. The right-of-way is currently unimproved, and due to the proximity to the creek, there is no potential for extension. The no objection letters received from all of the utility companies indicated no plans to extend any infrastructure into the subject property. The right-of-way would have been needed at one time to ensure that each of the three (3) adjacent lots to the right-of-way had access to E. Heritage Drive.
