THAT WE, Co - Brown Jr. , and wife Mary Brown, of Galveston
County, Texas, in consideration of the sum of One ($l. 00) Dollar and other
good and valuable consideration in hand paid by Galveston County, acting
through the Commissioners' Court of said County, receipt of which is hereby
acknowledged, do by these presents GRANT, BARGAIN AND CONVEY AS A
GIFT, subject to the reservation hereinafter made, unto Galveston County,
the free and uninterrupted use, liberty and privilege of the passage in, along,
upon and across the following lands in Galveston County, Texas, owned by

A 60 foot road through Block "B " of Central Park, Sarah McKissick
League, Galveston County, Texas.
Commencing at the North corner of Lot 2, Block "B", of Central
Park, a subdivision in the Sarah McKissick or J. R. Williams League,
in Galveston County, Texas, which point is also the East corner of Lot
No. 1 of said Block "B" and which is S44°59115"E. a distance of 6. 09
feet and S. 45°001 W. a distance of 20 feet from the West corner of
Lot 4, Block 3 of Friendswood Subdivision in the same League; thence
S. 45°00' W. , along the common line between said Lots I and 2 of said
Block "B", a distance of 73. 67 feet to a point in the Southwest line of
Sunset Drive, as said Sunset Drive is located by the Galveston County
Engineering Department and the beginning point of the roadway herein
described;
THENCE, from said beginning point, S. 39°04140" E. , along the
Southwest line of said Sunset Drive, as staked by said Department, a
distance of 23. 88 feet to the beginning point of the Southerly side of
said road herein described and which point is the beginning point of a
circular curve concave to the right;
THENCE, along the arc of said curve having a radius of 316. 71 feet and
a central angle of 39°101, a distance of 216. 5 feet to the end of said
curve;
THENCE S. 89°54'40" W. a distance of 139. 5 feet to the beginning point
of a circular curve concave to the Left;
THENCE, along the arc of said curve having a radius of 245. 87 feet and
a central angle of 37°04', a distance of 159. 06 feet to the end of said
curve;

The GRANTORS herein except from this easement and reserve for
themselves, their heirs and assigns, forever, all oil, gas, and other minerals,.
in and under the land covered by this easement, but said GRANTORS, for
themselves, their heirs and assigns, waive all right of ingress and egress to
and from the surface of the land covered by this easement for the purposes of
drilling, mining, exploring or developing such minerals.
For the purpose of opening, constructing and maintaining a permanent
road, or State Highway, in, along, upon and across said premises, with the
right and privilege at all times of the GRANTEE herein, his or its agents,
employees, workmen, and representatives having egress, ingress, and regress
in, along, upon and across said premises for the purposes of making additions
to, improvements on, and repairs to the said road or highway, or any part
thereof.
TO HAVE AND TO HOLD unto the said Galveston County as aforesaid
for the purposes aforesaid the premises above described.

in consideration of the sum of $10.00 and other good and valuable considerations in hand

SPECIAL, NONEXCLUSIVE RIGHT-OF-WAY EASEMENT
WHEREAS, by Right-of-Way Easement Deed recorded in
Volume 2015, Pages 89-91 of the Deed Records of Galveston
County, Texas, Cecil Brown, Jr. and wife, Mary Brown,
deeded a certain tract of land to Galveston County for
right-of-way purposes; and
WHEREAS, by Amendment to Right-of-Way Easement Deed
recorded in Vol. ,2/77 , Pages ,+O of the Deed Records of
Galveston County, Texas , Cecil Brown, Jr. and wife , Mary
Brown, added to said Right-of-Way Easement an additional
tract of land for the purpose of clarification of the ending
of said easement up to the property of Hirsch, Susman and
Westheimer in Block 13 of the Einar Hoidale Subdivision; and
WHEREAS, Cecil Brown, Jr. and wife , Mary Brown, have
requested Helene D. Susman to join in a certain petition to
the Commissioners Court of Galveston County to close a
certain dedicated road leading to said property of Hirsch,
Susman and Westheimer.
NOW, THEREFORE, Cecil Brown, Jr. , and wife, Mary
Brown, in consideration for Helene D. Susman' s joining in
said petition, do by these presents GRANT, BARGAIN, SELL
and CONVEY, subject to all reservations made in the above-
described instruments and all rights created thereby in
her heirs and assigns
Galveston County, unto Helene D. Susman,/the special, non-
exclusive liberty and privilege of the passage in, along,
upon and across the easement heretofore granted by said
instruments to Galveston County, it being expressly under-
stood that such special, nonexclusive easement gives the
Grantee herein the right to construct and maintain a road

To: All land owners along the Southeast side of Coward's Creek Drive
Re: City Water Service to your tract of land

Dear Mr. Leverton:
I have contacted some of the City officials with regard to obtaining
City water for the property owners along both sides of Coward's Creek
Drive. They indicated to me that the following terms for water could
he worked out with the City.
We. the land owners, would have to pay the expenses of the laying of
the water line which would include crossing Sunset Drive and installing
fire hydrants. This would have to be done according to the specifications
of the City. The line, when completed, wilt have to be turned over to
the City and will become their property and he their responsibility.
Based on the contractors estimate, it would cost every lot owner
approximately $500. 00--possibly less--but I could guarantee each
owner that it would not cost hime over $550. 00. I own all the Land on
the Northwest side of Coward's Creek Drive and would personally pay
of the expenses. The only other expense that you, as Lot owner, would
have is the customary tap charge when you hook up, and as long as you are
not within the City limits you would be charged 11- times the rate
charged within the City limits.
The $500. 00 for water would be only about L/3 or 1/4 of the cost of drilling
and installing a private water system, as you woul d have to go deep
enough to get soft water. Another advantage of city water would be the
reduction you would automatically receive on your fire insurance.
When final arrangements have been made with the contractor and the City
and a definite cost is established it will be necessary for each land owner
to deposit in the -riendswood Bank his share of the cost so that when the
installation is completed the contractor will be assured of his pay►.
If you are interested in this water line and will agree to pay your share
as herein stated, please sign the inclosed copy of this Letter and return it ,
which will indicate your approval of the terms as herein set out.
We will keep you posted as to the responses of other lot owners--there
are 10, including myself--involved in the Southeast side of Coward's Creek
Drive. As soon as I get the responses and a definite cost of construction
is made, I will I t you know. I expect to insist on completion of installation
within 90 days. Possibly it can be done much sooner. An early response
from each of you lot owners will be appreciated and is necessary in order
to proceed in obtaining final cost.

Dear Sir:
In reply to your request for the County of Galveston
to accept maintenance of Cowart ' s Creek Road, the road
has been inspected and core test made.
The road does not meet county specifications for roads
as set forth in"Rules , Regulations and Requirements
Relating to the Approval and Acceptance of Improvements
in Subdivisions or Re-subdivisions" as approved and
adopted by the Commissioners Court on April 22, 1963.
The road as constructed has a surface width from eight
feet to a maximum of sixteen feet, the depth of material
ranges from one inch to a maximum of three inches.
County Specifications require a minimum of six inches
of surface material with a roadway surface width of twenty
two feet.
Your request for acceptance of Cowart ' 13 Creek Drive will
be reconsidered when the road is constructed to County
Specifications.

Concerning the underground electric service as outlined in my Letter
of April 19, 1971, I signed the contract for the electric service on
April 16 and paid the required 1/4 of the cost in the amount of
$1, 233. 57. The balance of $3, 850. 69 is now due as construction of
the service has begun.
Please send me your share in the amount of .$640 with a check marked
electric sdrvice and I will deposit it in a special bank account to he
paid out to the Community Public Service Company when I have collected
from everyone.

Dear Mr. Gresham:
This letter is to request the Commissioner's Court of Galveston
County to accept maintenance of Coward's Creek road where it
crosses Central Park Subdivision North of Coward's Creek.
This road was originally built by myself and deeded to the County
in 1968. It replaces an original Dedicated road right of way across
. Central Park which was closed by the Commissioners Court on
June 21st, 1971., Maps and recording information for the Coward's
Creek Road were given to your office at the time the old road was closed.

This road serves 13 different property owners. Presently three of
these owners are living on their property and three other homes are
almost completed. .
The following home owners join with me in requesting the Commissioner's

Lear Mr. Christianson:
Would it be possible for the road administrator to
make a determination as to the state of Coward Creek Drive, in
Friendswood, as to its meeting County Specifications which would
be expected for a minimum acceptance by the County ?
We had correspondence in October 1971 about getting
this road accepted. At that time I received a letter from Mr. H.
M. Gresham stating the specifications. Since that time I have added
material bringing the section of road between Sunset and Greenbriar roads
up to County specifications. I have not made an additional acceptance
request because I have some sewerage taps to be made.
The part of Coward Creek Drive from Greenbriar
West is approximately the same as before. I am waiting for water and
sewerage developments there before bringing surface material of
roadway up to the County specifications.
You may recall Coward Creek Drive as the road we
drove over looking at the drainage easements which I gave to the
County. Greenbriar t'rive would be the road that we widened and
re-
aliraeG.
The section between Sunset and Greenbriar roads is the
one I am most concerned about. Since it is now in the City, the
acceptance of this road by the City is being based on the road having
met, or was nearing completion under County specifications.

A letter from your office to me, with a col to
Mr. James C. 'Morgan, City Manager, City of Friendswood, Texas
77546, stating your findings would be greatly appreciated. It would
in no way commit the County to anything other than as a fact finder.

Dear Sirs:
In reply to your letter dated February 13, 1973, regarding
annexation of property and in particular that which I have subdivided.
I appeared before the zoning commission Thursday, February 22, 1973.
At that time I,
1. Presented plats of current subdivisions.
2. Discussed drainage easement to relieve flooding across
F. M. 2351 from my property.
3. Stated that such easement had been given to the County.
4. Presented a form requesting the zoning of my properties.
5. Additinnally deeded an 80 foot roadway for the re-aligning
and widening of Greenbriar Drive to the County.
With regards to paragraph 3, of your letter, I would expect to
comply completely with the Friendswood subdivision ordinance on
future subdivisions. Paragraph 3 also states "it is not the intentions
of the City to impose financial hardships on these subdivisions that
are already nearing completion". At this point I would like to discuss
the subdivision work that I have done to date:
1. Divided the land along Coward's Creek Drive into 1 1/4 to 3
acre tracts.
2. Constructed Coward's Creek Drive in 1968.
3. Put Coward's Creek Drive across lots "B " and"G" in Central
Park Subdivision joining up to Lot 13 in the Hoidale subdivision.
It replaces a 40-foot easement across Central Park which I had the

4. Have sold a number of tracts as country home sites with
each owner being responsible for water and sewerage. Before
anyone built, however, the City laid their master trunkline
along Coward's Creek Drive, between Sunset and Greenbriar
roads. At this time we decided to each pay our share for the
construction of a waterline, making me pay one-half and the
lot owners the rest of the costs. The electric and gas improve-
ments were also shared.
.5. After the above improvements, I have maintained this road
and have restored the road bed as needed after each of these
constructions.
On October of 1971 the six homeowners and I requested the
Commissioners Court for maintainence of this road. The County's
reply stated the required surface material to meet County specifications
for roads as set forth in Rules, Regulations and Requirements as
adopted by the Commissioners Court on April 22, 1963.
In July of 1972 I added material between Sunset and Greenbriar
roads to bring that section of Coward's Creek Drive up to County
specifications. At the time that the City of Friendswood annexed
Coward's Creek Drive, I had not yet requested the Commissioner's
Court to re-evaluate this section because of four sewerage taps to
be put across this road.
Three-fourths of all the property along Coward's Creek Drive,
between Sunset and Greenbriar Roads, have presently been sold under
commitments to meet County specifications, therefore it would be a
financial hardship for me to meet City specifications on road requirements
on the one-fourth still owned by me.
I understand, from the newspaper, the City is accepting all roads
that the County has accepted. I feel that I have met the County requirements
and am entitled to the same priviledge.
There are three consecutive homes, extending 300 feet on the West
side of Greenbriar along Coward's Creek Drive, that have City water
and sewerage. The surface material on this part of the road does not
meet County requirements. I would like to be able to add sufficient
material to provide these people with an approved road and satisfy my
commitments to them. As for the rest of the road, I would like to
extend sewerage and water and bring the road up to County specifications.
I have worked with the County, a legitimate government authority,
over the years giving them road right-of-ways and much needed drainage
easements. I have felt confident that upon meeting County specifications
on road improvements, I was protected to make and fulfill agreements

and commitments to the people to whom I sold land.
I feel this matter can be resolved by working together and
reaching an agreement that would be satisfactory to the City and
appropriate for me.
