§ KNOW ALL MEN BY THESE PRESENTS :
COUNTY OF GALVESTON §
That CANE CORP. , a Texas Corporation, of the County of
Galveston, State of Texas (hereinafter referred to as
"Grantor") , for and in consideration of the growth, the
requirements , and the benefits to accrue to the citizens of the
City of Friendswood, Texas , has GIVEN, GRANTED, DONATED, AND
CONVEYED, and by these presents does GIVE, GRANT, DONATE, AND
CONVEY unto the CITY OF FRIENDSWOOD, TEXAS, a municipal
corporation organized and existing under the laws of the State
of Texas (hereinafter referred to as "Grantee") , that certain
tract or parcel of real property containing 3.3244 acres , more
or less , in Galveston County, Texas , being more particularly
described by metes and bounds in Exhibit "A" attached hereto
and made a part hereof for all purposes (hereinafter referred
to as the "Subject Property") .
This conveyance is expressly made subject to all matters of
record in the Office of County Clerk of Galveston County,
Texas , to the extent such matters affect the Subject Property.
TO HAVE AND TO HOLD the above described premises , together
with all and singular the rights and appurtenances thereto in
anywise belonging, unto the said Grantee, its successors and
assigns forever; and Grantor does hereby bind itself, its
successors and assigns , to WARRANT AND FOREVER DEFEND all and
singular the said premises unto the said Grantee, its
successors and assigns , against every person whomsoever
lawfully claiming or to claim the same or any part thereof, by,
through, or under Grantor, but not otherwise.

ORDINANCE NO. 86-28
AN ORDINANCE FINDING AND DETERMINING THAT PUBLIC
CONVENIENCE AND NECESSITY NO LONGER REQUIRE THE
CONTINUED EXISTENCE OF THAT CERTAIN PORTION OF CHESTER
DRIVE, AS DEDICATED BY DEED RECORDED IN VOLUME 2 ,
PAGE 24 , 2,5 OF THE DEED RECORDS OF GALVESTON COUNTY,
TEXAS ; VACATING, ABANDONING, AND CLOSING SAID PORTION
OF CHESTER DRIVE; AUTHORIZING THE MAYOR TO EXECUTE AND
THE CITY SECRETARY TO ATTEST QUITCLAIM DEEDS CONVEYING
SAID ABANDONED ROADWAY EASEMENT TO ISRAEL GOMEZ AND
WIFE, MARIA, AND GEORGE WELCH AND WIFE DARLA, THE
ABUTTING PROPERTY OWNERS OF SAID ROADWAY EASEMENT, FOR
GOOD AND VALUABLE CONSIDERATION; AND CONTAINING OTHER
PROVISIONS RELATING TO THE SUBJECT.
WHEREAS , Israel Gomez and wife , Maria, and George Welch and
wife , Darla , the abutting property owners of the below
described roadway easement , have petitioned the City of
Friendswood , Texas , to vacate , abandon , and close the said
below described roadway easement ; and
WHEREAS , the City Council has determined that such roadway
easement should be vacated , abandoned , and closed for reason
that the same is no longer needed by the City; and
WHEREAS , said roadway easement has been appraised by a
qualified appraiser and the appraisal report of such appraiser
has been taken into consideration by the City Council ; now,
therefore
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD ,
STATE OF TEXAS :
Section 1 . The City Council of the City of Friendswood ,
Texas , hereby finds and determines that public convenience and
necessity no longer require the continued existence of the
hereinafter described roadway easement .
Section 2 . The roadway easement described in Exhibit "A"
attached hereto and made a part hereof is hereby vacated,
abandoned , and closed .
Section 3 . The Mayor is hereby authorized to execute and
the City Secretary is hereby authorized to attest a quitclaim
deed , conveying the hereinabove abandoned roadway easement to
abutting property owners , as follows :
