FOWLER and wife BARBARA A. FOWLER, hereinafter called "Grantor", for and in consideration of the sum of TEN AND NO/100 DOLLARS ($10.00) and other valuable consideration, to us in hand paid by THE CITY OF FRIENDSWOOD, a duly and legally chartered municipal corporation of the County of Galveston, State of Texas, hereinafter called "Grantee",the receipt and sufficiency of which is hereby aclmowledge?,have GRANTEE), SOLD,and CONVEYED,and by these presents do GRANT, SELL, and CONVEY unto the said Grantee, its successors and assigns and legal representatives, a perpetual easement and right of way for the purpose of maintaining, constructing, reconstructing, repairing, relocating, and removing a sewer line and related facilities over the following described property situated in Galveston County, Texas: A five foot (5') in width Surface Drainage Easement out of Lot 2, in Block 1, in the R. W. Barr Subdivision, a subdivision in Galveston County, Texas, according to the map or plat recorded in Volume 18, Page 347 in the Office of the County Clerk of Galveston County,Texas,and being more particularly described by metes and bounds as follows: COMMENCING at a point at the most Northwest corner of the R. W. Barr Subdivision also in the Southeast R.O.W. of Murphy Road; THENCE N. 45° 00' 00" E., a distance of 134.36 feet to a 1/2 inch iron rod for the most Northwest corner of Lot 2 of said subdivision; THENCE S. 45° 00' 00" E. following the property line between Lot 1 and Lot 2 to a point perpendicular to the farthest point of the concrete driveway from Murphy Road; THENCE N. 45° 00' 00" E., a distance of 5.0 feet to the Northeast line of an existing drainage easement to the PLACE OF BEGINNING; THENCE S. 45° 00' 00" E. on the existing drainage easement line to a point 10 feet from the back property line; THENCE N. 45° 00'00" E., a distance of 115.00 feet parallel to the back property line to a point on another drainage easement line; THENCE N. 45° 00' 00" W., a distance of 5 feet along said drainage easement's northwesterly line to a point 15 feet from the back property line; TI- E S. 5o00' 00" 7 1 t �;,eof i .n 0 feet iiei to the „i,. :.L dC� .,. 4 �. ., a �.is :� _ . ... n p^ra .,k property line of Lot 2 to a point on the Southwest building line; THENCE N. 45° 00' 00" W., to a point perpendicular to the farthest point from Murphy Road of the concrete driveway of Lot 2; THENCE S. 45° 00' 00" W., a distance of 5.0 feet to the PLACE OF O12-"83 -"1885 ' r � TO HAVE AND TO HOLD all and singular the rights and privileges aforesaid to Grantee, its successors and assigns, in common with Grantor and Grantor's successors and assigns.
