EASEMENT

§ KNOW ALL MEN BY THESE PRESENTS:
COUNTY OF HARRIS §
THAT the undersigned, Hale/Associates , Inc. , hereinafter called
"Grantor," for and in consideration of the sum of ten dollars
($10 . 00) and other good and valuable consideration, to it in hand
paid by the City of Friendswood, a duly and legally chartered
municipal corporation of the Counties of Galveston and Harris ,
State of Texas , hereinafter called "Grantee , " the receipt and
sufficiency of which is hereby acknowledged, has (subject to the
conditions hereafter stated) GRANTED, SOLD, and CONVEYED, and by
these presents does GRANT, SELL, and CONVEY unto the said grantee,
d its successors and assigns and legal representatives a temporary
easement over and across the tract of land described on Exhibit "A"
attached hereto and made a part hereof. Said temporary easement
shall be for the purpose of storing equipment, materials , and
supplies relating to and associated with the construction by
Grantee of certain potable water facilities on property (Project
Site) located adjacent to such temporary easement.
It is hereby agreed and understood that the temporary easement
granted hereby shall expire within sixty (60) days following the
completion of such construction upon the Project Site, or by
February 28 , 1990 , whichever first occurs . In addition to the
foregoing, Grantee takes such temporary easement subject to�06 31I2,3gs

1 . Grantee agrees to indemnify Grantor, to the extent
permitted by law, from all liability for claims from any party for
any type of damages occurring during the period of time such
temporary easement is under Grantee' s control .
2 . Grantee agrees that it will establish grades and
elevations on the Project Site which will substantially comply with
the preliminary plans prepared by Wayne Smith & Associates dated
January 1989 and in no event will the development of Grantee' s
potable water system result in surface water drainage from the
Project Site to the area within said temporary easement following
completion of the project.
3 . Grantee will , during the period of time in which this
temporary easement is in effect , strip the area within the
temporary easement of weeds , grass , roots , etc. , to dirt level and
will place a minimum of four inches (4") of crushed limestone or
stabilized shell over the entire temporary easement and grade same
so that no ponding will occur thereon.
TO HAVE AND TO HOLD the above-described temporary easement,
together with all and singular the rights and appurtenances thereto
in anywise belonging, including all necessary rights of ingress ,
egress , and regress , unto the said Grantee, its successors and
assigns . And Grantor does hereby bind itself, its successors and
assigns to warrant and forever defend, all and singular, the said
temporary easement and rights unto the said Grantee , its successors
and assigns against every person whomsoever lawfully claiming or to
claim the same or any part thereof.

May 4, 1989
0.2779 acre (12, 107 square feet) of land out of an 0.5226 acre
tract in Reserve "G", Block 19, Forest Bend Subdivision, Section 3, in
Harris County Texas, according to the plat of said subdivision recorded
in Volume 180, Page 73, Harris County Map Records, said 0.2779 acre of
land being more particularly described as follows:
COMMENCING FOR REFERENCE at the northeast corner of Reserve "G"
and the northeast corner of an 0.7471 acre tract, on the curved west
right-of-way line of Blackhawk Boulevard, 100 feet wide:
THENCE in a southerly direction with the east line of Reserve "G"
and said west right-of--way line with a curve to the right having a
radius of 1950.00 feet, a central angle of 6 degrees 10 minutes 13
seconds and an arc length of 210.00 feet, (the chord of said arc bears
South 20 degrees 06 minutes 01 seconds East 209.90 feet) , to the
southeast corner of said 0.7471 acre tract and the northeast corner of
an 0.5226 acre tract of which the tract herein described is a part;
THENCE continuing in a southerly direction with the east line of
Reserve "G" and said west right-of-way line with a curve to the right
having a radius of 1950.00 feet, a central angle of 0 minutes 35
seconds 21 minutes and an arc length of 20.05 feet, (the chord of said
arc bears South 16 degrees 43 minutes 14 seconds East 20.05 feet) , to
the Northeast Corner and PLACE OF BEGINNING of the 0.2779 acre tract
herein described;
THENCE continuing in a southerly direction with said line and said
curve to the right having a radius of 1950.00 feet, a central angle of
2 degrees 22 minutes 23 seconds and an arc length of 80.76 feet (the
chord of said arc bears South 15 degrees 14 minutes 22 seconds East
80.76 feet) , to a point for corner;
THENCE South 81 degrees 12 minutes 44 seconds West a distance of
162.90 feet to a point for corner;
THENCE North 12 degrees 35 minutes 27 seconds West a distance of
69.87 feet to a point for corner;
THENCE North 77 degrees 24 minutes 33 seconds East a distance of
158.81 feet to the PLACE OF BEGINNING and containing 0.2779 acres.
