GRANTED, BARGAINED, SOLD AND CONVEYED and by these presents does GRANT, BARGAIN, SELL AND CONVEY unto the CITY OF FRIENDSWOOD, a Home -Rule City of the State of Texas ("Grantee"), all of the property described as an 11,542 square foot tract of land out of and being part of the remainder of called 21.8110 acre tract described in deed from George A. Bofysll, JR. to Friendswood Lakes, Inc. under Galveston Co:.,nty Clerk's File No, (G.C.C. File No.) 2000031706, being situated in the City of Friendswood, Galveston County, Texas and being more fully described by metes and bounds on Exhibit "A" attached hereto and made a part hereof by reference (the "Property"). THIS CONVEYANCE IS MADE BY GRANTOR AND ACCEPTED BY GRANTEE subject to the terms, conditions and provisions hereof and further subject to all applicable easements, conditions, restrictions, covenants, mineral or royalty interests, mineral reservations, surface waivers, liens, encumbrances, regulations or orders of municipal and/or other governmental authorities, if any, or other matters of record, to the extent, but only to the extent, they are validly existing and affect the Property (collectively "Permitted Exceptions").
