The fire department and the City Council decided two weeks ago to build a fire sta- tion 40 feet off Farm Road 518 on a two-acre tract at this corner. T h e highway department has preliminary plans to cut 50 feet off the corner to straighten out the course of the road when they extend the four lanes now under con- struction in Friendswood to the Gulf Freeway in League •City. But the conflict, which was disclosed at a meeting Thurs- day of both parties, doesn't appear irreconcilable. "We haven't signed a con- t r a c t yet," Mayor Ralph Lowe said of the fire station. But he said there is enough land to move the station back if necessary so the highway project can go through. "These plans are not firm at all,"Hilliard Butler, senior engineer with the highway de- partment, added. He explained that the pro- posed route of any Farm Road 518 expansion still has to meet environmental stan- dards and survive a public hearing. "If they build the station, it would make it (the cutoff) less likely,"Butler said. But Lowe said he has asked fire department officials to reconsider their plans. The proposed project is in full accord with local outdoor recreation plans inasmuch as it will preserve and make available to the general public an area which is endowed with the natural beauty found only along the banks of small creeks,in a general area of flat prairieland with little natural vegetation. The park site is in accord with the state outdoor recreation plan as per a telephone conversation with Mr. John Livingston, Texas Parks and Wildlife Department on the 20th day of February, 1973. Approximately 50 percent of the land is grown up in pine trees and large live oaks. The two parcels of land lie on opposite sides of Cowards Creek with the creek forming the boundary of one of the parcels. The second parcel is contiguous to the first by means of a city right- of-way along the creek. The City of Friendswood and the surrounding area within a radius of from 8 to 10 miles is predominantly a bed-room community with very little open or planned recreation areas. The climate is moderate in the area and it is expected that the park will receive intense utilization on a year-round basis. • There are no environmental intrusions such as power high-lines of high pressure gas lines within the park area. B. Other organizations consulted during formation of this proposal : I. Local civic and garden groups II. Various city departments including Planning Commission III , Director, County Parks and Wildlife Department IV, Owner of property to be purchased C. To utilize to the fullest the wooded creek portion of the area, a trail bridge would tie the two parcels together to allow more extensive foot- paths, horse and bike trails. The woods would be left in a natural state with the exception of these trails, complimenting the fact that Friendswood, by action of the City Council , has been designated as a bird sanctuary. Open areas will be utilized for swimming pool and related buildings, tennis courts, playgrounds, restrooms, and picnic areas. With the NE boundary of the property being F.M. 518, the park would serve travelers along this thoroughfare as well as residents of the general area.No regulation ball fields are planned for this area; a parcel of land on the NW side of the city has been developed for this sport. Development of the area could be started immediately upon finalizing the purchase of the parcel of property as set forth in the accompanying Projedt Proposal for Acquisition. M ' MAPS AND CHARTS A. Lot 48 and part of Lots 49 and 50, Voss S/D, Friendswood This parcel sold on May 29, 1973 for $8,600 per acre. The parcel contains 10.88 acres and is located approximately one-half mile south on the same side of FM 518 as the subject property. Because of its excellent shape and utility, we feel that a +5% should be added to the price, thus making this property well within a $9,000 per acre valuation. 2. Block 6, Lot 11 , Friendswood Subdivision This 10.938 acres was purchased on February 15, 1973 at a price of $9,000 per acre. This parcel which is located just south and across FM 518 from the subject property, is, we feel , on a par value with it. Therefore, we feel that the $9,000 selling price was equitable. 3. Tract 4 out of the Perry and Austin League, Patent #349 This parcel of land located at the far end of FM 518, and containing 19.6497 acres of land, was purchased on September 7, 1973 at a price of $12,000 per acre. In our evaluation of this sale, we have deducted 10% because the property has less valuable frontage, and 15% because we feel that the location is not the most desirable for general business. For these reasons we feel that $9,000 per acre would be a fair value for this particular parcel of land as compared with the subject property. 4. Block 6, and parts of Lots 1 , 2, and 11 , Friendswood Subdivision This 4.8 acres was sold on March 2, 1973 for $7,500 per acre. Due to the overall value of property in the entire city, and the desirable location of this parcel , this price appears to us to be somewhat low. I prefer to tell a person directly what displeases me. I served on the Park and Land Use Committee as your appointee. I soon became aware that the land on 518 was the only possibility for a centrally located park. After much deep thinking, I was convinced that this would be the one beauty spot along the main street of Friendswood and I voted to recommend the City obtain this site but it riot be used for a baseball diamond or football field. We desperately need recreational facilities of a different nature that will serve the community from Senior Citizens to the very young. Baseball and football serve a minority group. I suggest you contact the town of Okemos, Michigan, a suburb of Lansing, inhabited by University professors, doctors, lawyers, etc. , and ask for details of their federally funded recreational program. We also need to provide ways to keep our young people amused right here in town, as the people of Okemos have done. A good recreational program will lessen juvenile delinquency, vandalism, drug problems, etc. Okemos is the living proof. I defenitely do not like what I hear-- that plans for a baseball diamond and/or a football field for the new park site are already in the making, disregarding the recommendation of the Park Committee completely. (2) pop ENVIRONMENTAL IMPACT STATEMENT BY THE CITY OF FRIENDSWOOD 650.1 1 . The proposed park site is located on a farm-to-market road which is the main thoroughfare through the City, and lies within the central business area. The site itself runs along the highway and back to a wooded area along a creek. No plans have been made for development of the park; it will remain at present in its natural state as an outdoor area. This site is joined by a road right-of-way to a ten-acre park site which was acquired by the City in 1970 with a 50% grant from H.U.D. 2. The wooded area, which constitutes approximately one-half of the site, is typical of the areas along the creeks running through this city. Open portion of the land possibly would be used for tennis courts, swimming pool , or other recreational facilities. If this land is not acquired as park land it will probably be utilized for a shopping center or for an apartment complex, either of which would eliminate any preservation of the natural environment. 3. Acquisition and use of this land as a park should present no environmental damages. It would remain primarily in its natural state. Any adverse environmental impact could only come from allowing this land to be used as commercial or multi-family dwelling development. As a public park the area would be maintained and controlled by rules aimed at perserving the beauty and utility for the eitizens of the area. 4,. None foreseen. Land use rules including zoning in the city will control possible adverse environmental impacts on property surrounding this site. 5. - 6. - 7. We do not see any adverse effects to the environment, nor any short-term nor long term impacts if this land is kept in its present open-space condition. Rather than destroy any resources, this action would tend to preserve same. 8. One alternate would be not to purchase the land for park purposes. r '. We would like to urge the city of Friendswood to purchase the Stevenson property for a city park. Naturally we are interested in tennis, and hope that public tennis courts will become a reality in the future in Friendswood. But also, and I believe most important, we are all parents who are concerned about the future of our children. They must have some place in their own hometown to go to for recreation. The proposed park site is accessible to all the youth of Friendswood. It is a beautiful piece of land, and we would be very dissappointed to see it developed into another shopping center, apartment complex, etc . Friendswood needs a park and we feel it would be a terrible mistake not to purchase such a beautiful site. Currently one can apply for Federal Outdoor Recreation funds through the Texas Park & Wildlife Commission. The Federal Land & Water Conservation Act has an FY 73 allowable appropriation of 230 million; however, only 50 million of this figure is being released at present so if you are to actively seek assistance from this revenue source you need to enter your application as soon as possible. The President has only this week sent his version of a Land Management Bill to the Congress; a portion of this bill will allow for the acquisition of land by state and local governments to be used for recreational and open space (green belt) areas. My advice to Friendswood and all local communities is that they start an orderly program now to acquire lands for future recreational development. There is a great awakening of public concern regarding our limited land resources. Innovative legislature is appearing at both the federal and state levels regarding land use management. Indiscriminate development of land for personal, commercial and industrial use is a thing of the past. I would suggest, if Friendswood has not already done so, that a Parks Board be established to oversee this important aspect of community life. If you desire assistance in preparing an application for funding or choose to seek other sources of additional revenue for recreational land use development, please feel free to call upon me. The correspondence and news clippings all relate to the proposed pur- chase by the City of certain park land. Apparently, from the informa- tion in these attachments, a grant from the State Parks and Wildlife Department may relate to the park purchase also. Mr. Krch appears to have addressed this agency on the basis that funds derived from a sewer service contract with Water District 108 are being used as the basis for what might be termed interim or temporary funding for the park purchase. Insofar as I can ascertain, this agency has no jurisdiction with regard to the expending of municipal funds as has been proposed. It appears that we have no jurisdiction over funds derived from the contract with the Water District. It appears at this writing that this agency's proper interest extends only to the question of whether sewer service to District 108 and the City of Friendswood is in any way impacted by the , Mayor Ralph L. In spite of the complete rejection of the Mayoras grand plans by the voters of this city on two seperate bond elections, in regards to a so called regional waste water treatment plant and the rejection of the same plans by the Environmental Protection Agnecy, because it called for a large trunk line to cross a vacant land mass, the Mayor once again is playing the magic numbers game with a bond election and with sewage treatment funds. The Mayor proposes to use monies that are bascially consigned to sewage treatment pint improvement and enlargement with some form of advanced wast4 water treatment, by diverting about $46,000 from the Forest B nd ."rater District ,'1ICD-108 funds to buy a park site that the voters of this city rejected on two seperate votes by a significant margin. It is thei writers opinion that funds, badly needed, for sewage treatment should not be directed to buy a park site that the voters rejected. These funds should instead be used to start to correct the large infiltration problem that the present sewage system has, and other problems due to growth etc. Plans such as the crossing of potential developmentland by a large trunk line as the Mayor proposes is not to the interest of the people of the city of Friendswood. EPA has recognized the free ride by developers of such a situation and congress saw fit to place some restrictions on such funding. It is also this writers opinion that the TNQB should investigate ' the diverting of sewage funds to other projects, rejected by the voters of this cith and its effect on possible future grants. At this point in time the T"IQB can best serve the people of Friendswood and the Lake area by a very close review of sewage treatment plant DESIGN so that the maximum effect can be derived from the minimum dollars spent. At the present time we have a park of a reasonable size that is not and I repeat not maintained properly. To make certain of this I visited the site and ford the existing buildings in various stages of collapse just before writing this letter to you. A select group of people "horsemen" were allowed to build and maintain an arena. However the present city administration has done nothing to enhance the general use of this site. Therefore I do not believe if past action is any guide, that a new site would receive any better care. On two seperate elections the votes have defeated"a bond issue to buy the proposed sity by a significant'rargin: the people if Friendswood have determined other priorities, roads, drainage, and sewage treatment must cone first. Ken Pagans Chairman, Parks and Beach Commission Lloyd Criss Architects: Lyman Reed Mr. Clements R. Gonzalez remarked on the need for a larger rec area to serve the growing Friendswood area. Also the need for youth counseling in conjunction with the work of the PD. He said that the school rec facilities will be available for use by the general public starting in mid-February. Paul Hopkins said that the counseling program was not a part of the County Parks and Recreation but rather of the Juvenile Probation Department. Mr. Pagans seems to be somewhat of an authority on park grants and, regarding our request from HUD, he stated that HUD grants were not geared to the affluent communities such as Friendswood but rather for the low-income minority-group communities. He suggested that we work up an application through the Department of the Interior, Bureau of Outdoor Recreation (Land and Water Courses Plan) . Contacts in Austin for these grants are: John Livingston, Grants & Aid Div. , Texas Parks and Wildlife Department. Also a good friend of his,. Jim Watt in the Local Assistance Division who would help us work up an application. These grants are divided into quarters and the applications at this time would have to be in by March 1 . Mr. Pagans indicated that he would help us in any way he could. Mayor Lowe indicated that he might make some of the preliminary contacts if he goes to Austin on Monday. Mr. Reed said that they are now processing an application for Nassau Bay for a 10-acre park site, and he will send us a copy of the application which they have submitted. Mr. Pagans was given a copy of the HUD application which we submitted and which has just been turned down. Mr. Pagans said that Dr. Barrage of A&M (Mott Foundation) specializes in programs utilizing school facilities around-the-clock and suggested that if the city and the school worked together on recreation facilities that much more could be accomplished for the community as a whole for less money, and that the grant people smile on this type of cooperation. It also gains approval of citizens. Larry Smith, College of the Mainland, is also interested in these projects . Slides were shown on a proposed county park at Camp Wallace (Senator Brooks Park) Other items: Jerry Esmont was suggested as a consultant on counseling. Currently one can apply for Federal Outdoor Recreation funds through the Texas Park & Wildlife Commission. The Federal Land & Water Conservation Act has an FY 73 allowable appropriation of 230 million; however, only 50 million of this figure is being released at present so if you are to actively seek assistance from this revenue source you need to enter your application as soon as possible. The President has only this week sent his version of a Land Management Bill to the Congress; a portion of this bill will allow for the acquisition of land by state and local governments to be used for recreational and open space (green belt) areas. My advice to Friendswood and all local communities is that they start an orderly program now to acquire lands for future recreational development. There is a great awakening of public concern regarding our limited land resources. Innovative legislature is appearing at both the federal and state levels regarding land use management. Indiscriminate development of land for personal, commercial and industrial use is a thing of the past. I would suggest, if Friendswood has not already done so, that a Parks Board be established to oversee this important aspect of community life. If you desire assistance in preparing an application for funding or choose to seek other sources of additional revenue for recreational land use development, please feel free to call upon me. Mr. Krch appears to have addressed this agency on the basis that funds derived from a sewer service contract with Water District 108 are being used as the basis for what might be termed interim or temporary funding for the park purchase. Insofar as I can ascertain, this agency has no jurisdiction with regard to the expending of municipal funds as has been proposed. It appears that we have no jurisdiction over funds derived from the contract with the Water District. It appears at this writing that this agency's proper interest extends only to the question of whether sewer service to District 108 and the City of Friendswood is in any way impacted by the , Mayor Ralph L. It is thei writers opinion that funds, badly needed, for sewage treatment should not be directed to buy a park site that the voters rejected. These funds should instead be used to start to correct the large infiltration problem that the present sewage system has, and other problems due to growth etc. Plans such as the crossing of potential developmentland by a large trunk line as the Mayor proposes is not to the interest of the people of the city of Friendswood. EPA has recognized the free ride by developers of such a situation and congress saw fit to place some restrictions on such funding. It is also this writers opinion that the TNQB should investigate ' the diverting of sewage funds to other projects, rejected by the voters of this cith and its effect on possible future grants. At this point in time the T"IQB can best serve the people of Friendswood and the Lake area by a very close review of sewage treatment plant DESIGN so that the maximum effect can be derived from the minimum dollars spent. To make certain of this I visited the site and ford the existing buildings in various stages of collapse just before writing this letter to you. A select group of people "horsemen" were allowed to build and maintain an arena. However the present city administration has done nothing to enhance the general use of this site. Therefore I do not believe if past action is any guide, that a new site would receive any better care. On two seperate elections the votes have defeated"a bond issue to buy the proposed sity by a significant'rargin: the people if Friendswood have determined other priorities, roads, drainage, and sewage treatment must cone first. Ken Pagans Chairman, Parks and Beach Commission Lloyd Criss Architects: Lyman Reed Mr. Clements R. Gonzalez remarked on the need for a larger rec area to serve the growing Friendswood area. Also the need for youth counseling in conjunction with the work of the PD. He said that the school rec facilities will be available for use by the general public starting in mid-February. Paul Hopkins said that the counseling program was not a part of the County Parks and Recreation but rather of the Juvenile Probation Department. Mr. Pagans seems to be somewhat of an authority on park grants and, regarding our request from HUD, he stated that HUD grants were not geared to the affluent communities such as Friendswood but rather for the low-income minority-group communities. He suggested that we work up an application through the Department of the Interior, Bureau of Outdoor Recreation (Land and Water Courses Plan) . Contacts in Austin for these grants are: John Livingston, Grants & Aid Div. , Texas Parks and Wildlife Department. Also a good friend of his,. Jim Watt in the Local Assistance Division who would help us work up an application. These grants are divided into quarters and the applications at this time would have to be in by March 1 . Mr. Pagans indicated that he would help us in any way he could. Mayor Lowe indicated that he might make some of the preliminary contacts if he goes to Austin on Monday. Mr. Reed said that they are now processing an application for Nassau Bay for a 10-acre park site, and he will send us a copy of the application which they have submitted. Mr. Pagans was given a copy of the HUD application which we submitted and which has just been turned down. Mr. Pagans said that Dr. Barrage of A&M (Mott Foundation) specializes in programs utilizing school facilities around-the-clock and suggested that if the city and the school worked together on recreation facilities that much more could be accomplished for the community as a whole for less money, and that the grant people smile on this type of cooperation. It also gains approval of citizens. Larry Smith, College of the Mainland, is also interested in these projects . Slides were shown on a proposed county park at Camp Wallace (Senator Brooks Park) Other items: Jerry Esmont was suggested as a consultant on counseling. "Regional Crime Squad" was mentioned by Paul as answer to county crime problems, but he feels that city police can use authority in the areas around the city limits - outside. B. Henry • TEXAS PARKS AND WILDLIFE DEPARTMENT ACQUISITION PROJECT PROCEDURES (Land and Water Conservation Fund Program) Section 301 of the Uniform Relocation Assistance and Real Property Acquisition Policies Act of 1970, Public Law 91-646, established certain procedures to be followed in the acquisition of real property by Federal agencies or by other agencies receiving Federal financial assistance. As a result of the requirements imposed by the Act, the Bureau of Outdoor Recreation revised its policy with respect to acquisition requirements on L&WCF projects. Effective February 1, 1972, the following policy and procedure will apply to all acquisition projects approved on or after that date: a. An acceptable appraisal meeting the State Grants-in-Aid Manual require- ments must be secured before the initiation of negotiations for the purchase of real property. The seller or grantee must be informed in writing of the value of the property based on the results of the appraisal. The offer must be not less than the grantor's estimate of the fair market value as determined by the appraisal. b. The owner or his designated representative shall be given an opportunity to accompany the appraiser during his inspection of the property. The appraisal report must indicate whether or not he accompanied the appraiser. Responsibilities of Sponsor P p The following check list will insure compliance with the Act: a. The sponsor makes the initial contact with seller to see if the land is for sale. The original contact should be to determine if the owner of the property is willing to sell the property for park purposes. At this point no price should be negotiated. If the owner is willing to sell he should be informed of his rights and the rights of any tenants under the Relocation Act (See Title II) and permission should be obtained to inspect the property and have it appraised. If land is to be acquired by con- demnation, States will be required to follow their own State laws regarding the procedures to follow for condemnation. b. The sponsor obtains information as to whether or not relocation of owner or tenants will be involved and advises them of their rights under P.L. 91-646. c. The sponsor has the land appraised and gives the owner an opportunity to be present during the inspection of the property by the appraiser. (The appraiser should be MAI, SRA or SREA. See Part 6675.2.8.B of the State Manual.) d. The sponsor submits the appraisal for review by the State. Upon receiving approval of the appraisal the sponsor then has an acceptable determined fair market value of the property to be acquired. April 1972 -2- e. The sponsor informs the owner in writing of the value of the property based on the results of the appraisal using a letter or a standard form similar to the sample "Statement of Just Compensation." (Attached) f. The sponsor negotiates the selling price with the owner. If the selling price is less or greater than the appraised value, a State of Differ- ences in Value must be prepared in accordance with Section 6675.2.4 of the State Manual. This statement must be sent to the State who in turn will send a copy to BOR. After the project is approved and the State has reviewed the appraisals and informed the sponsor the land can be purchased, the following documentation is required for reimbursement: a. Cover letter stating land has been purchased and requesting reimbursement. b. Two copies of a formal appraisal report to include the five-year history of transactions (See Part 6675.8B of the State Manual.) Note: The appraisals were furnished the Department for review prior to the land being purchased. c. Two copies of offer to seller (Statement of Just Compensation.) d. Statement of Differences in Values (if necessary). e. Proof of ownership and legal rights obtained. (Two xerox copies of the deed and city or county (sponsor) attorney's opinion of the title, if not clearly explained in the deed.) If you obtain a title insurance policy, send two xerox copies. f. Proof of payment (Two copies of cancelled checks, both sides). Appropriate permanent acknowledgement of Land and Water Conservation Fund assis- tance is required. The Land and Water Conservation Fund symbol should be displayed on a project sign located at the site as soon after purchase as possible. Please refer to Chapter 8, Part 6675 of the Manual for additional information and sug- gestions. The enclosed decal may be used, but experience has shown that painting the symbol on the project sign has proven more satisfactory. Permanent recognition may be done in a number of ways, such as maintaining the project sign or a plaque. Suggestions on a plaque are enclosed. (Attachment to Statement of Just Compensation) INFORMATION FOR LANDOWNERS AND TENANTS ABOUT BENEFITS UNDER THE UNIFORM RELOCATION ASSISTANCE AND REAL PROPERTY ACQUISITION POLICIES ACT OF 1970 - PUBLIC LAW 91-646 The Uniform Relocation Assistance and Real Property Acquisition Policies Act of 1970 provides for certain benefits and payments to displaced persons (landowners and tenants) which result from the sale of land to a government agency (Federal, State or local) . The law provides for benefits and payments for which you may be eligible in the following areas: 1. Reimbursement of moving and related expenses or certain substitute payments. 2. Replacement housing allowance under certain conditions. 3. Relocation assistance services to help relocate replacement housing, farms, or business properties. 4. Reimbursement of certain expenses incurred in selling real property in which Federal funds are involved. These payments and benefits are discussed in greater detail in the following paragraphs. 1. Reimbursement of moving and related expenses. Displaced owners and tenants are eligible for reimbursement of actual expenses incurred in moving themselves, their families, and their personal property from Land acquired for Federal or federally-assisted programs. When a com- mercial mover is used, the reimbursement will be the amount charged. If the actual expenses are to be claimed, accurate records must be kept and bills and receipts obtained to support an application for reimbursement of expenses. Reimbursement for actual moving expenses shall not exceed the estimate or amount charged by a commercial mover. In addition to moving expenses, actual direct losses of tangible personal property as a result of moving or discontinuing a business or farm operation may be reimbursable but not to exceed the cost of moving such property. Owners or tenants displaced from a business or farm operation are eligible for an additional payment not to exceed $500 for expenses incurred in searching within a 50-mile radius for a replacement business or farm. Should an owner or tenant displaced from a dwelling prefer, he may accept substitute payment of $200 plus an allowance of up to $300 (based on the size of dwelling moved from) instead of actual moving expenses. A schedule of allowable payments will be furnished. -2- Should a displaced person from a business or farm operation prefer, he may accept a substitute payment instead of actual moving and search for relocation property expenses of not less than $2,500 nor more than $10,000, based on the actual net income before income taxes. To qualify as a farm operation, the farm must contribute, or be capable of contributing, at least one-third of the operator's support. To qualify as business it must be shown that (1) it cannot be relocated without a substantial loss of its existing patronage, and (2) it is not a part of a commercial enterprise having at least one other establishment not being acquired by the Government. 2. Replacement housing allowance. In addition to reimbursement of moving expenses, owners or tenants actually occupying dwellings on the property acquired by a government agency under a Federal or federally-assisted program may be eligible for a payment to help them purchase or rent a decent, safe, and sanitary replacement dwelling. This payment may be in the form of (A) a differential payment, or (B) a rent sup- plement, or (C) a down payment allowance. (A) Differential payment. A payment which when added to the purchase price of the dwelling acquired by the Government agency would enable the owner occupant to acquire a decent, safe, and sanitary dwelling in the same general area from which he was displaced. The maximum amount that can be allowed for a replacement dwelling shall in no case exceed $15,000. To qualify for this payment an owner occupant must have occupied the dwelling for not less than 180 days prior to the initiation of negotiations by the Government agency (the date the first monetary offer was made) . (B) Rent supplement. The amount necessary, when added to the actual rent or fair cash rental, whichever is greater, which will enable a displaced tenant or owner occupant to rent a decent, safe, and sanitary dwelling for a period not to exceed four years, but in no case shall the total amount of such payment exceed $4,000. The Government will determine the maximum amount necessary to rent a replacement dwelling. Total payments in excess of $500 will be made in four equal annual installments. To qualify for this payment, a tenant or owner must have occupied the dwelling acquired by the Government for not less than 90 days prior to the initiation of negotiations. An owner occupant of more than 180 days prior to the initiation of negotiations may elect to receive this payment instead of the differential payment, but not to exceed the amount he would have received as a differential payment. (C) Down payment. The amount necessary to make a down payment for purchase, including closing costs, on a decent, safe, and sanitary dwelling but not to exceed $4,000, however, any amount over $2,000 must be matched on an equal basis by the displaced tenant. The amount required for a down payment cannot exceed the minimum needed in the area for a conventional loan plus closing costs. The same occupancy qualifications apply for a down payment as for a rent supplement. -3- 3. Relocation Assistance. The Government agency will, to the greatest extent possible, assist displaced landowners and tenants in locating and becoming established in a decent, safe, and sanitary replacement housing, and in locating replacement farm and business properties. It would also provide assistance in completing appli- cations for moving and other expenses and payments authorized by Public Law 91-646. Should you have questions, the Government's negotiator will be glad to discuss them with you, or you may write to the State Government office in charge ofFederal d - gor federally-assisted assisted program. The Government will, upon request, provide any lending institution, or other interested party, with a statement of expenses and allowances for which you as a displaced owner or tenant are eligible under Public Law 91-646. 4. Reimbursement of expenses incurred in selling real property when Federal funds are used. (Relocation expenses only) Landowners are eligible for reimbursement of certain expenses incurred by them in conveying title to real property to the Government (Political Subdivision). The expenses eligible are: (A) Recording fees, transfer taxes, revenue stamps, and notary fees. (B) Penalty costs for pre-payment of pre-existing recorded mortgages as may be required to convey a clear title to the Government agency (Political Subdivision). (C) The pro rata portion of real property taxes which would apply to the period after the date title vests in the Government, or the effective date of possession by the Government (Political Subdivision), whichever is earlier. It is the obligation of the landowner to pay these expenses initially, and then claim reimbursement by application.
