FRIENDSWOOD DRIVE, FRIENDSWOOD,TEXAS,WITH THE FOLLOWING PRESENT CONSTITUTING A QUORUM: MAYOR KIMBALL BRIZENDINE COUNCILMEMBER JOHN LECOUR COUNCILMEMBER LAURA EWING COUNCILMEMBER TRACY GOZA COUNCILMEMBER DAVID SMITH COUNCILMEMBER CHRIS PEDEN COUNCILMEMBER MEL MEASELES CITY ATTORNEY LOREN SMITH CITY MANAGER RON COX CITY SECRETARY DELORIS MCKENZIE 3:00 PM—WORK SESSION Discussion was held regarding Capital Projects Update and Public Safety Building. Community Development and Public Works Director Mike Hodge and Capital Projects Coordinator Skipper Jones presented a PowerPoint presentation and gave an overview of Capital Improvement Projects(CIP) process that included, Historical information on developing the CIP, 2003 Bond Election development process, funding sources for 2003 Bond Projects, Forces-At-Work discussion, Project-by-Project review, Fire Station IV,and Public Safety Building (PSB) discussion and reported that a new CIP manual is upcoming. A lengthy discussion was held regarding clarifications, as well as problems with the Design Build process as it directly relates to the planning for the PSB Building and future buildings. A question and answer session took place between Council and Staff. Staff recommended terminating the contract for Design Build with Vaughn Construction,contracting with new Architects to complete the bid documents, and to competitively bid the PSB Project under a sealed competitive proposal based on qualifications and price.These items are included for Council's consideration later in this agenda.The lessons learned are that the recent material cost trends are cause for a full update of CIP Manual. The new manual will include updated costs for all remaining projects, factor-to-adjust cost for future dollars and cost for project if delayed. Discussion was held regarding Policy for Setting Annual Tax Rate. Administrative Services Director Roger Roecker presented a PowerPoint presentation regarding Truth-in-Taxation overview, Effective Tax Rate,2004 Effective Tax Rate calculation on September 11,2004, based on Galveston County Appraisal District value as of May 17,2005,tax calculation-average new Single Family Residential,Tax Revenue Impact and Area Tax and Exemption Survey. Further discussion was held regarding developing a policy for setting the annual tax rate, charging Staff with a goal to come in with the effective tax rate on the tax rate for this budget year and encourage Staff to reduce funds when rollover of unexpended funds is historical,would like to look atsalestax revenues and projections. Staff will work with the Effective Tax Rate in developing the budget. 06/06/05 2320 6:00 PM—CLOSED EXECUTIVE SESSION Council convened into Executive Session in accordance with the Texas Government Code,pursuantto Section 551.072—Deliberation regarding Real Property and Section 551.074—Personnel Matters. Council convened into Regular Session at 7:00 pm with action taken later in the meeting RECONVENE INTO OPEN SESSION 7:00 PM—REGULAR SESSION The Invocation was given by Associate Pastor Randy Castillo from Calvary Chapel. Mayor Brizendine led the Pledge of Allegiance to the United States and to the State of Texas. Parks and Recreation Director Jon Branson introduced Michelle Bossert, one of nine finalists in the Star Competition,who was chosen to perform, singing the Star Spangled Banner for the Council meeting. SPECIAL RECOGNITION AND ACKNOWLEDGEMENTS City Manager Ron Cox made a special presentation of the Five Star Award for the First Quarter of 2005 to Cheri Skelton, Development Coordinator with the Community Development Department. Cheri is the Development Coordinator for the Community Development Division. Cheri was first hired on June 3, 2002, as a Project Manager. After all her hard work and dedication, she was promoted to the position of the Development Coordinator in June 2003. Both her fellow employees and customers of the CDD nominated her. Cheri's responsibilities include coordinating and guiding development applicants through the permitting and approval processes,and working with the city procedures pertaining to zoning,development,and redevelopment. Cheri also serves as staff support for the Planning and Zoning Commission. We appreciate Cheri for her hard work and for portraying the Five Star Spirit in our city through her attention to detail, and determination to achieve satisfaction with the residents and builders of Friendswood. Mr.Cox also presented the Comprehensive Annual Financial Report(CAFR)Award to Administrative Services Director Roger Roecker and Staff. The Government Finance Officers Association (GFOA), a national organization of finance officers serving governments,sets standards for financial reporting. Organizations that meet these standards are eligible for this Certificate of Achievement for Excellence. As you can see,GFOA has awarded this certificate to the City of Friendswood. The excellent work of the Administrative Services Department, under the direction of Roger Roecker, has once again been acknowledged and rewarded. This is the 17th consecutive year for this recognition. We appreciate Roger and his staff for their dedication to the city and the citizens. Mayor Brizendine recognized outgoing Councilmember Shannon Kimmel and thanked him for his greatservice and sacrifice to the City. Mayor Brizendine asked permission to move item #6, Communications from the Public, before the Joint Docketed Public Hearing. **Councilmember Measeles moved to approve moving item#6, Communications from the Public, before the Joint Docketed Public Hearing. Seconded by Councilmember Goza. The motion was approved unanimously. 06/06/05 2321 Mayor Brizendine stated that with that in mind,we will move on to Communications from the Public. And let me just make a few statements about this. We appreciate any opportunity for our citizenships to engage the Council on any issue. We appreciate your input. Generally speaking for non-agenda items,what we do is we will refer those comments to our City Manager and Staff will follow up at a later time. For an agenda item,such as this one tonight, I'm going to give some latitude here. Because,quite honestly,after interacting with our City Attorney, our City Attorney could not definitively, in my mind, resolve the issue of interaction between Council and those that wish to speak and dialogue with Council and I could not discern any definitive information on that either. So,what I would like to do is I would like to give those four people: Kathy Rogers,Sean Tracy,Gary Pitts and Steve Newcombe, an opportunity to address Council and dialogue with Council. If Council has any questions or comments, I am going to allow that tonight, pending further clarification from our CityAttorney and whatever the outcome,we can amend the process at a later date. I would just like to remind the four that are formally on the agenda that those comments given during the communication from the public section,will not be a part of the record of the Public Hearing. So if you want your comments to be a part of the Public Hearing record, then I would advise you to get back up when asked by the facilitator of the Planning and Zoning Commission and give the same comments again if you want. My inclination is to go through the fourthat are on the agenda, and then I will go ahead and take any persons from the audience wishing to address other issues as they see fit according to the Communications from the Public. With that in mind, I'm going to askthat if those four people or if any one of those four people, Kathy Rogers, Sean Tracy, Gary Pitts or Steve Newcombe, would like to address the Council at this particular point in time. COMMUNICATIONS FROM THE PUBLIC Kathy Rogers,207 Charleston,addressed Council and stated she would like to thank those from the Planning and Zoning Commission and Council who came out to view the properties and responded to calls and e-mails regarding the zone classification change request for 1501 Winding Way. Sean Tracy, 402 Charleston, addressed Council and stated he would like to thank those who responded, unfortunately not all are in the subdivision. He stated there are 34 lots on Charleston, 1501 Winding Way is not in subdivision,when property was purchased everyone thought properties would remain residential, no other commercial property on Winding Way which is the entrance into the subdivision. Steve Newcomb, 406 Charleston, addressed Council and stated he would speak during the Public Hearing portion of the meeting. Gary Pitts, 301 Charleston, addressed Council and stated he had three objections to the zone change classification of 1501 Winding Way with the first being economic impact which will adversely impact home values if zoning change is approved and it will be a net loss in taxes to the City,second will affect the aesthetics of the entrance into the subdivision if corner lot at the entrance is changed to commercial, and third will be concern for safety,since there are approximately 38 children in the subdivision. The subdivision could consider controlled access into the subdivision for security purposes but if re-zoning this property happens,it breaches the opportunity and the option goes away. Councilmember Smith asked if there were a possibility for this project to be perfect,would it be worthwhile to go through the process. Mr. Pitts said no, did not think so, what if property changes hands, how would it be considered. Councilmember Ewing asked about the zoning of the properties located on Winding Way and Mr.Pitts outlined the areas. 06/06/05 2322 Councilmember Goza asked if the Homeowners'Association has deed restrictions. Mr.Pitts responded thatthe property is technically not in the subdivision but previous owners participated. Don Johnson, 810 Myrtlewood, addressed Council and stated he lives on Clear Creek,wants to speak on the Clear Creek Project, urged Council to use caution,the buzzword is reforestation or buyout properties,could be 85 homes in Friendswood, does not know what the plan is, thinks that Friendswood should look into the proposed plan and not try to retain all of the flood waters from the surrounding areas. Mark St.Cyr, 105 Prairie Wilde,addressed Council and stated he would like to ask about the flooding problem in the Eginus Subdivision along FM 2351,is asking for status, has not heard from anyone,heard from surveyors that they are going to double the pipe from Ms. Hicks' property, asked to get on the agenda to discuss this, drainage runs west to east,asked for resolution and has been asking for six years,the Mayor referred him to the City Manager and gave him the option for appearing on the agenda. JOINT DOCKETED PUBLIC HEARING Mayor Brizendine and Planning and Zoning Commissioner Bob Bertrand called a Joint Docketed Public Hearing to order, to receive comments from the public, either oral or written, regarding a Zone classification change request for 0.3788 acres at 206 E. Shadowbend from Multi-Family Residential-Medium (MFR-M) to Multi-Family Residential-Low(MFR-L). Chair Kevin Holland was out ill and they wished him a speedy recovery and Vice Chairman Jim Gibson asked to be recused from one portion of the Joint Docketed Public Hearing. Michael Pina, 11811 Gulf Point Drive, stated he wants to rezone the property in order to build a two-unit town home on property. Billy Trump,209 E.Shadowbend,stated he lives across the street from the project,built his home about 4 years ago, there are other new homes in the area, has lived here almost 35 years, opposed to duplex, feels it will diminish home values, does not know if it will be rental property, realized it is zoned for Medium but does not want that either. Rae Powell,201 E.Shadowbend,stated he agreed with the previous speaker regarding the rezoning request. Bill Whipkey, 207 Shady Nook, stated this property backs up to his home, Multi-Family Residential—Medium would be 9 units per acre and Multi-Family Residential-Low would be 6 units per acre, all property around is residential,does not see why apartments would be allowed, renters throw things over fences they do notwant. Darrell Sasser,210 E.Magnolia,stated he bought property in this area for a better life for his family,there is no other Multi-Family Residential in this area, it would diminish property value, and is opposed to this project. Mayor Brizendine and Planning and Zoning Commissioner Bob Bertrand closed this Joint Docketed Public Hearing. Mayor Brizendine and Planning and Zoning Commissioner Bob Bertrand called a Joint Docketed Public Hearing to order, to receive comments from the public, either oral or written, regarding a Zone classification change request for 2.147 acres at 1501 Winding Way from Single Family Residential (SFR) to Office Park District(OPD). Richard Peterson,5307 Whittier Oaks,stated he has lived here since 1975,is the owner of 1501 Winding Way, and his business partner has lived here for 9 years. He and his partner have a vested personal investment in Friendswood because they also own property across the street at 1401 Winding Way. He 06/06/05 2323 explained he started his business five years ago in Friendswood, but the lease for the business has expired. He works with shipping companies, does logistics work for shipping mostly on computers or by phone, has a handful of employees, other offices in Corpus Christi and in New Orleans, does not deliver or ship, does not have any material stored onsite nor deliveries, only office equipment and will only have deliveries of office supplies,does not expect more than five employees,does not expect this will impact the traffic,or for entering or existing the property,does not have any current plans to alter the structure,is pleased with current structure and landscaping, reviewed current zoning of adjacent commercial property. He further stated that 1501 is not a part of Pilgrims Point subdivision, brought a rendering of proposed building to be built across the street from 1501 Winding Way, hopes it will add to the quality of the street and hopes that if any development ever occurred at 1501 Winding Way, it would compliment the other commercial buildings,the only part of the 2.147 acres is where the home is located, the other part is undeveloped, this ads to the goal of Economic Development of commercial properties, of the ten adjacent properties that surround this property, six of the properties are commercial, request consideration to rezone property. Councilmember Peden asked Mr. Peterson why he chose this zoning rather than Planned Unit Development (PUD),was actually suggested a higher zoning but chose to go for Office Parks District(OPD). Pamela Beeth,5003 Whittier Oaks,stated she is a neighbor of Richard Peterson,knew him before either one of them had children, is here to tell residents of Charleston they could not find finer neighbors,do not think they have anything to worry about. Steve Baughman, 202 Charleston, stated he has lived here continuously since 1986 and that only having the driveway onto 1501 Winding Way lends it to commercial. He announced he would build Mr. Peterson a driveway onto Charleston if he wants to live in the home. If property ownership turns over,it would change the property use,Mr. Baughman stated he lives here because of the quiet neighborhood,encroaching commercial into subdivision changes that and Winding Way is one of the busiest streets in Friendswood. Don Glasgow, 109 Charleston,stated he has lived here since 1995, rebutted some of the information from the rezoning report, previous owner of 1501 Winding Way, Bernie Peterson, considered himself a part of the subdivision,even serving on the Board.Mr.Glasgow provided information on values of properties,property has a lot of tree cover and Friendswood is losing a lot of trees. It is clear that the property is a part of the subdivision,where is the support for this re-zoning,where is the benefit to the City,and only sees one person it benefits. Carrie Hunnicutt, 1804 San Jose,applauded Council for responding to citizenswho are speaking here tonight.If property is rezoned, property values will go down,there will be dumpsters,traffic coming and going,Charleston has very little traffic,wants Friendswood to remain as it is now, asked not to change to Office Park. Sean Tracy,402 Charleston,stated this rezoning is a train wreck,what happens when property changes,what will happen to property then and to the values of the properties. There is only one way in and one way out of the subdivision and it should remain residential, previous owners acted as if they were a part of the subdivision and participated in the Homeowner's Association process, sees it going backwards. Rebecca Yeater,206 Charleston, has lived in Friendswood since 1980,read a statement into the record,moved to Charleston Street in 1991,also had a home business on Charleston and when the company grew and added employees,she had to move to office space elsewhere. Rebutted rezoning report with difference of opinions, most residents were not advised of the public hearing in time to protest property values, if approved,this will certainly affect property values, Winding Way is a residential street with heavy traffic with current amount of commercial property, asked Council to look into the future and see that this is not good for Friendswood if residential property can be changed so easily to commercial, asked Council to please vote no to rezoning. 06/06/05 2324 Stephen Newcomb, 406 Charleston, stated he has lived in Friendswood for 17 years, decided to stay in Friendswood for all that Friendswood stands for and all of the services provided and the supporting community values. He looked at goals on the website and asked does leadership want a relationship with someone who has not followed the letter of the law in moving a business into a residential home and does not maintain the visual image. Furthermore, homes within 200 feet will have to live with the changes if zoning change is approved,what about when the property changes hands,when you develop a business you wantto grow it,so it would require the office facility to grow,with having a partner,changes could happen,do not believe this meets the cities goals, asked Council to consider information. Richard Melancon, 403 Charleston, stated he is troubled about the project and by all that is proposed. Mr. Peterson has already done some things that are suspect, this is our property we are talking about, will employees be working 24 hours per day,City will lose taxes if this is changed,will devalue property,not going to be additional taxes from this commercial property,troubling issue with traffic, cited rezoning report and traffic information,already need to widen Winding Way,what will it cost the taxpayers for this,this is a special place,is a one street subdivision,we all have a choice where we live, do not change Friendswood into Pearland. John Morawski, 103 Charleston, stated he lives across from 1501 Winding Way, appreciates all of the neighbors on this street speaking on this issue, rebutted the rezoning report, it is not fair to change the zoning midway. If the property is rezoned,it could change use,are there other areas that have a residence that faces commercial. The loss of trees really bothers him, this is a beautiful wooded lot and hope it stays that way, reviewed information off the website,spoke in support of open green space and growth and development that meets the City's goals, and asked Council not to rezone. Mayor Brizendine called a brief recess at this time. Art Williams,306 Charleston,stated he served on Friendswood Independent School District Foundation since it's inception, supports education, is a business owner with 40 employees, it is a good thing to own property, after some statements from the new owner has question regarding his integrity, he bought residential, it is cheaper, leave it residential as forefathers zoned. Joan Cooper, 210 Charleston, asked for those who are not speaking from Charleston to stand, thinks the property should stay residential as the rest of the subdivision, moved here 16 years ago from Houston, hopes Council does not take lightly this rezoning, and asked things to remain the same. Loren Shriver, 108 Charleston,stated he has lived here 5 years, has same concerns heard here tonight,asked what is it City hopes to gain by rezoning this property that has been residential for the last 27 years,chose to live here because of all that Friendswood has to offer,teach our children all the right things to do to be honorable, have ethics. He further stated most businesses have ethics and fairness,quoted the City's mission statement from the newsletter,quoted Vision 2020 statements, rezoning this property will not promote any of those goals, why rezone from single family residential to any other classification, unethical to residents, betrayal to homeowners, and asked respectfully not to change the character. Janell Keith, 101 Charleston,thanked everyone for listening,agreed with everyone who has spoken,he home is directly across from the property, kitchen window looks at property and sees the traffic coming and going, moved to this property in 2000,thought 1501 was a part of the neighborhood,and is concerned with the traffic. She has a disabled child with multiple problems, concerned with children's safety, if rezoning is approved will definitely change property values, stated their property will never sell,would eliminate possibility of a security gate. 06/06/05 2325 Wade Keith, 101 Charleston, presented photos taken from home of 1501 Winding Way, stated he fells that living in Pilgrims Point is such an accomplishment,grew up about 8 miles from here, is a business owner and understands ethics of business, and how a developer would want to utilize land to the fullest, and does not agree with changing this property. He also stated Charleston is the heritage of Friendswood,it is beautiful and tranquil, please do not rezone. Kathy Rogers, 207 Charleston, stated the Homeowner's Association is not against commercial, look at this project, this is different, also thinks about the loss of revenue not only to the City but to the School District. Additionally, she gave an overview of the residents and those who relocated to this subdivision, and asked Council to look at pictures that have been submitted, look at petition that has been signed by virtually all of the homeowners and two of the business owners on Winding Way,asked them to look at the petition carefully and hopes they will give due diligence and look at the property. Phyllis Peters, 105 Charleston,stated the previous owners thought they were a part of the subdivision,do not know what will change in the future for a commercial property,feels sorry for neighbors thatwould have to look at this if the property changes to commercial. She chose Friendswood and does not want rezoning. Bill Peters, 105 Charleston, reiterated the same thing and feels very strongly about this request, asked what happens in the future to this property if it changes hands,with Planning and Zoning Chairman stating zoning will not change, appreciates time to speak on the issue. Bill Reeves 201 Charleston, asked Council to do what is best for the community as a whole, this petition supports that. Russell Burkett, 309 Charleston, stated he appreciates all those who have spoken and those who presented information,this is a one-way in and one-way-out subdivision, is a beautiful piece of property,symmetry to the street, symmetry planning is obvious in Friendswood,this is what makes Friendswood what it is,this is"spot" rezoning of property that has been zoned Single Family Residential (SFR) for almost 30 years. Once the property is rezoned there is no guarantee, which is what everyone is concerned with and concerned about traffic. He has looked at other commercial properties being built now and the loss of trees and is concerned that the trees on 1501 will be lost, hopefully Council will see this logic of the symmetry and the flow over the last 30 years. Mayor Brizendine and Planning and Zoning Commissioner Bob Bertrand called a Joint Docketed Public Hearing to order, to receive comments from the public, either oral or written, regarding a Zone classification change request for 3.1940 acres on FM 518 from Neighborhood Commercial (NC)to Community Shopping Center(CSC). John Montgomery of New Quest Properties, stated he represents owners of the property, the request for rezoning was to allow for the development of an auto repair facility on a portion of this property and location of property adjacent to Walgreen's and day care center. Lewis Ten Have with Christian Brothers Automotive Corporation,stated there are 31 stores in 6 states,which are owner operated, Friendswood is the type of place he wants to bring quality business to and Christian Brothers Automotive Corporation is a first class operation, has met with the Development Review Committee to begin the development process. 06/06/05 2326 Rebecca Yeater, 206 Charleston,would like to have more information on this proposed development before moving forward. Mayor Brizendine and Planning and Zoning Commissioner Bob Bertrand closed this Joint Docketed Public Hearing. COMMUNICATIONS FROM COMMITTEES AND SPECIAL REPORTS Senior Citizens Advisory Committee Chair Sharon Richardson recognized Staff and presented their annual report on the Senior programs which is enjoyed by everyone,sees a growth in membership,appreciates all that supporters and the City of Friendswood do to support the Senior Program. CITY MANAGER'S REPORT City Manager Ron Cox presented the Houston 100 Club and Galveston 50 Club Officer ofthe YearAwards and stated the City has been fortunate in the past to have police officers honored by both the Houston and Galveston Clubs.These clubs are formed for the specific purpose of honoring police and fire personnel from the respective areas. This year, both clubs have honored two members ofthe Friendswood Police Department. The Friendswood Police Department and Chief Robert Wieners are proud to recognize Michael Scambray as their recipient of the 2004 50 Club Officer of the Year Award for outstanding law enforcement efforts while serving during the previous year. Officer Scambray has served with the Friendswood Police Departmentsince May 2003. He is recognized for his accomplishments in arrest activity and traffic enforcement, but of most significance is his interdiction of suspected drug dealers. Officer Scambray initiated a traffic stop of a suspected drug dealer that resulted in what has been one of the largest drug seizures in Friendswood's history. This incident netted three pounds of marijuana,over 400 grams of Ecstasy,over 88 grams of Xanex,over67 grams of crystal meth, and over 127 grams of cocaine. This bust led to the seizure of guns, cash and a vehicle. Officer Scambray is very proactive. He is committed to serving the department, city, and citizens with service above and beyond expectations and always with a positive attitude. He also became a member of Friendswood's Crisis Negotiation Team this year. Officer Scambray is married to his wife,Christy,and has one child, Brittany. He served in the United States Marine Corps for four years, was a close-quarters battle instructor, and was trained in gorilla warfare and infantry tactics. He received the National Defense Medal, Good Conduct Medal,Joint Military Unit Citation,Marine of the Year,and numerous other letters. Beforejoining the Friendswood Police Department he served as a Boot Camp Senior Drill Instructor for Montgomery County Juvenile Probation. Houston 100 Club's Officer of the Year for 2004 is Officer Chris Scofield of the Friendswood Police Department. His award is based on the achievements,qualities,and dedication that Officer Scofield has demonstrated throughout this past year and during his law enforcement career. Officer Scofield was assigned as a School Resource Officer for the past two years at the Friendswood High School. During this time, he continued an important partnership with the Friendswood Independent School District and built a solid foundation. He was able to identify problem areas at the school and made numerous recommendations including better security, more lighting, and additional video cameras in strategic areas. As a result of his diligence and dedication to his duties, there were no significant criminal events at the high school. Officer Scofield not only makes himself a valued employee of the police department, but he also made himself a valued team member with principals,teachers, and staff while performing the duties of the School Resource Officer. Additionally, his work with the students has earned the respect and admiration of the student body. On April 2,2004,while working the evening patrol shift,Officer Scofield and other officers responded to a domestic disturbance on Live Oak Street. During the ensuing investigation,the female suspect approached officerswith a knife in her hand. After failing to obey officers'commands to halt and drop the weapon,officerswere leftwith little choice but to use some type of force. Officer Scofield was the primary officer on the scene, but later received support from Officer Niki Bender. Officer Scofield would have been justified in using deadlyforce,but recognized the fact that he and officer 06/06/05 2327 Bender were armed with less lethal weapons. Both officers continued to make commands to the female suspect to drop her weapon. When the commands were ignored, Officer Scofield was forced to use his less lethal weapon. As a result of both officers'actions, no officers were injured and the female suspect received only minor injuries that caused no long-term disability. In June 2004, Officer Scofield was reassigned to the Patrol Division, midnight shift,after completing his two-year commitment as a School Resource Officer. On the morning of July 22, 2004, while off-duty and on his way home, Officer Scofield witnessed a burglary at a commercial business in League City. After notifying our dispatcher of the circumstances, he remained in a position to watch the suspects until League City police could arrive. Afterthe suspects leftthe business,Officer Scofield followed the suspect onto the Gulf Freeway and maintained a visual on the suspects and their vehicle until officers from League City PD could make a felony stop. As a result of Officer Scofield's actions, three suspects were arrested and charged with burglary of a building and several thousand dollars worth of property was recovered. On the morning of August 4,2004,Officer Scofield was assigned to the west side patrol district in Friendswood. Part of Officer Scofield's duties was to check businesses in his districtto insure their protection. In the early hours, he was checking businesses in the area of Sunmeadow and West Parkwood. As he observed the various businesses, he noticed suspicious activity. Upon further investigation, he uncovered a burglary in progress at the Reddy Liquor Store. Officer Scofield notified the dispatcherthat he had at leastthree suspects and requested back up. As a result of Officer Scofield's actions,two suspects were arrested at the scene and the third suspect was later identified. Officer Scofield is a licensed Emergency Medical Technician. Throughout his career as a police officer, he has also assisted surrounding jurisdictions as a volunteerworking with local fire departments and ambulance services. Officer Scofield has dedicated his career to assisting and serving his fellow citizens in several ways, and is appreciated by all who know him. His dedication and loyalty stand out as one of his most beneficial characteristics. Mr. Cox reported on the Police Department Records Management System (RMS) Citation Software. As originally defined,this project included connecting the City's police department network to Galveston County's Sheriff's Office (GC) network. This would have allowed the City to share data with Galveston County. By passing data to them, the City would allow their system to temporarily perform the Records Management function (RMS). As such, the City would not have needed to purchase the RMS software right away. After several months of trying and through no fault of the City, Galveston County or OSSI, the City was unable to establish connectivity to the Galveston County network. To get this project on track,the City's only recourse is to purchase the RMS software now. Through negotiations with OSSI, the City will be able to secure a 60 percent discount off the price of the RMS software from $19,750 to $7,900. The RMS software will be purchased from the Information Technology operating budget. The plan to connect to other agencies for the purpose of sharing data is an excellent one and the City should continue thinking in that direction. League City is in the process of implementing the full complement of OSSI software as Galveston County has done. The City of Webster is planning to connect to League City's system. If that effort goes well,the City of Friendswood will be considering it also. ACTION ITEMS **Councilmember Measeles moved to approve action regarding the Mayor's appointment of Councilmember David Smith as Mayor Pro-Tem for 2005-06. Seconded by Councilmember Ewing. No action was taken and the motion and second were withdrawn. **Councilmember Ewing moved to approve action regarding the City of Friendswood membership in the Clear Creek Nature and Cultural Tourism Council. Seconded by Councilmember Measeles. The motion was approved unanimously. **Councilmember Goza moved to approve action regarding the City Secretary's annual performance review and a merit increase of 5%annually and stated the City Secretary exceeds expectations,Council is impressed 06/06/05 2328 with her job performance and professionalism and is appreciative of her many years of service. Seconded by Councilmember Peden. The motion was approved unanimously. **Councilmember Smith moved to approve action regarding the new Public Safety Building and authorization of Change Order No. 1 to the Part II Design Services for the Public Safety Building with Vaughn Construction. Seconded Councilmember Ewing. The motion was approved unanimously. **Councilmember Measeles moved to approve authorizing the Mayor to execute a contract with Perkins and Will Architects for the completion of the design, bid process and construction management services. Seconded by Councilmember Smith. The motion was approved unanimously. ORDINANCE **Councilmember LeCour moved to approve the Second and Final reading of Ordinance No. T2005-17,An Ordinance amending Appendix C of the Friendswood City Code,said Appendix C being City of Friendswood, Texas, Ordinance No. 84-15, as amended, originally adopted the 19th day of November 1984, and being the zoning Ordinance of the City, by changing the zoning classification of a certain tract of land totaling 45.8921 acres from Single-Family Residential (SFR)to Planned Unit Development(PUD),such tract being known as Lots 1 through 29, Block 1, Lots 1 through 24, Block 2, and Reserves A through G, Hunters Creek Estates Subdivision, in the City of Friendswood, Galveston County, Texas, within the City limits of the City and by granting a Specific Use Permit(SUP)for use of said property as a Private Street—Gated Community; providing for the amendment of the City's official zoning map; providing for severability; and providing a penalty in an amount not to exceed $2,000 for each day of violation of any provision hereof. COMMUNICATIONS FROM THE MAYOR AND COUNCILMEMBERS Councilmember Ewing reported that Library Director Mary Perroni's and Betsy Finger's summer programs have begun and that they are appreciative to the Friendswood Rotary Club for their monetary donation to the Library. Councilmember Peden congratulated Deputy City Secretary Melinda Welsh for earning her first certificate for Texas Municipal Clerk's Association (TMCA)Certification Program and thanked Mayor Brizendine for allowing speakers from the Communications from the Public portion of the agenda to speak prior to the Joint Public Hearing. Councilmember Measeles invited everyone to the Concert in the Park on Friday at Stevenson Park. Mayor Brizendine attended the 100 Club Banquet with Police Chief Bob Wieners and Deputy Chief Captain Luke Loeser honoring Officer Chris Scofield for his good work on two felony burglary arrests and one life threatening attack and arrest, both above and beyond the call of duty.
